Your original content can be one of your business’s most valuable assets. When another party copies it or accuses your company of copying, you need advice and assistance from an attorney that is experienced and knowledgeable in copyright law.
Sierra IP Law, PC is an intellectual property law firm that has been helping clients enforce and defend their rights for decades. Our legal team handles copyright infringement cases involving all forms of copyrighted material, including software, photographs, graphical works, architectural and building designs, website content, marketing materials, music, and video and multimedia. Our attorneys include Mark D. Miller, who is AV Preeminent Peer Review Rated, and William K. Nelson, who has been selected to Northern California Super Lawyers.
Copyrights protect original expression in works such as photographs, written content, software, music, and artwork. Copyright infringement occurs when someone exercises protected rights without the owner’s permission or an applicable legal exception. Unauthorized reproduction, distribution, public performance, public display, or adaptation can create liability. Common examples of copyright infringement include copying product photographs onto a competitor’s site, distributing software without a license, or using protected music in advertisements.
In cases alleging copying, courts examine ownership of a valid copyright and whether the defendant unlawfully copied protected expression. Evidence of access to the original work and substantially similar protected expression may support an infringement claim, while similarities in ideas, facts, or unprotected functional features alone do not establish infringement.
At Sierra IP Law, we evaluate copyright ownership, registration, and the scope of protection, and give you a candid assessment of the strengths and weaknesses of your case. We compare the original and allegedly infringing works, review relevant agreements, and examine the evidence supporting each claim and defense, including fair use, licensing, and independent creation. We explain how the evidence, available remedies, and potential liability affect your options, so you can make informed decisions about protecting your business or defending against a claim.
We have broad experience handling intellectual property disputes involving a wide variety of legal issues in multiple industries, including film and television, photography, graphic design, fashion design, and software. That experience helps us understand how creative work is developed, commissioned, licensed, and used commercially. It also informs our assessment of ownership, contractual obligations, and the financial impact of alleged infringement. We use that understanding to develop a strategy with you that reflects your business goals and the circumstances of your case.
A well-supported cease and desist letter is a common starting point for enforcement and can resolve a copyright dispute before litigation. Negotiations can also resolve infringement cases before trial. Our attorneys weigh settlement terms against the costs and potential benefits of a lawsuit. When copyright litigation is necessary, we will pursue or defend the infringement claims through discovery, motion practice, and trial.
If litigation is necessary, our copyright litigators examine, among other things, ownership, registration, evidence of access, and whether the works are substantially similar in their protected expression. We evaluate financial harm and the strength of your position in formulating our strategy. We manage the legal dispute on your behalf to arrive at the optimal resolution. This may mean pushing settlement negotiations early or aggressively pursuing litigation in appropriate circumstances. We strive to protect your rights and provide the best available outcome.
If your business faces copyright claims, our lawyers examine the strength of the plaintiff's claims and your potential defenses, such as fair use, waiver, license, independent creation, and functionality. Whether a demand comes from a publisher, a photographer, musician, or other copyright owner, we assess the allegations and your options.
Copyright remedies can address financial harm and stop continuing infringement. Depending on the circumstances, a court may issue an injunction, award actual damages, and require the infringer to surrender profits attributable to the infringement, without double recovery. Actual damages may include proven lost profits or the fair market value of a license for the unauthorized use. To recover infringer profits, the copyright owner must establish gross revenue reasonably related to the infringement. The defendant bears the burden of proving deductible expenses and profits attributable to other factors.
If the infringed work is protected by a copyright registration at the time of infringement, statutory damages are available as alternative basis for recovery. Statutory damages range from $750 to $30,000 per work infringed, with awards up to $150,000 per work for willful infringement. Eligibility generally depends on whether the copyright owner pursued registration in a timely manner. For qualifying innocent infringement, courts may reduce statutory damages to as low as $200 per work. A prevailing copyright owner’s eligibility for attorneys’ fees also generally depends on timely registration, and any award remains within the court’s discretion.
The attorneys at Sierra IP Law will review sales records, licensing history, and other evidence to assess recoverable losses and potential liability. We explain the strengths and limits of the damages evidence, evaluate whether injunctive relief is warranted, and help you weigh settlement against litigation costs. Our strategy reflects both the legal merits and the practical value of the remedies to your business.

The Digital Millennium Copyright Act (DMCA) provides a notice-and-takedown process that can prompt online platforms to remove or disable access to infringing material. Effective DMCA notices identify the copyrighted work and disputed content, provide its online location, and include required statements of good faith and authority.
At Sierra IP Law, we assess copyright ownership, preserve evidence, and consider licensing and fair use before recommending action. We prepare takedown notices, evaluate responses, and provide a candid assessment of the strengths and risks of your position. If your content is removed, we explain your options, including whether a counter-notice is appropriate.
A compliant counter-notice can lead to restoration 10–14 business days after the platform receives it, unless the platform receives notice that the copyright owner has filed a court action seeking to restrain the alleged infringement. We explain the deadlines and litigation implications so you can make informed decisions. We also assess digital rights management issues, including potential claims involving bypassed access controls or removed copyright notices, as part of a content protection strategy tailored to your business.
Copyright protects original works of authorship automatically when they are fixed in a tangible medium, such as a saved file or recording. Copyrights apply to creative expression. They do not protect ideas themselves. Under federal law, a copyright owner receives exclusive rights, subject to exceptions. For most individually authored works created since 1978, protection lasts for the creator’s life plus 70 years. Different rules apply to works made for hire and older works.
Copyright registration is optional for protection but strongly recommended. A U.S. work generally must be registered with the U.S. Copyright Office before its owner files an infringement lawsuit in federal court. Early registration can also preserve eligibility for statutory damages and attorneys’ fees. Generally, registration before infringement begins, or within three months after first publication of the copyrighted work, preserves access to those remedies. The benefits of copyright registration are many, and it is highly recommended that registration be sought for creative works promptly.
Our copyright infringement attorneys are focused on intellectual property law, and we protect creators’ rights and guide companies through copyright matters. Choosing the best lawyers for your needs involves considering relevant litigation experience, clear communication, and a strategy suited to your business.
