Your brand is often your company’s most valuable asset. When another business copies your brand or accuses you of trademark infringement, your business, reputation, and investment are at risk. A trademark litigation attorney can help you protect what you have built and respond with a clear plan.
Sierra IP Law, PC is an intellectual property law firm serving businesses in California and Washington. Our trademark attorneys have extensive experience representing clients in trademark disputes, court litigation, and Trademark Trial and Appeal Board proceedings. Mark D. Miller is AV Preeminent Peer Review Rated, and William K. Nelson was selected to Northern California Super Lawyers.
We give you a candid assessment of the strengths and weaknesses of your case, explain your options, and develop a strategy with you that reflects your business goals. Every case is different, and we tailor our representation to your particular circumstances, objectives, and needs.
Trademarks and service marks distinguish your goods or services from those of other businesses. Trademark litigation often concerns confusingly similar brand names, logos, slogans, or trade dress. In trademark infringement cases, courts assess the likelihood of consumer confusion using judicially developed factors, including the similarity of the marks, the similarity of the goods and services, overlap in the channels of trade, and evidence of actual consumer confusion.
At Sierra IP Law, we assess the legal strength of your mark, determine priority of use between the parties, and give you a candid evaluation of the strengths and weaknesses of your case. We examine the evidence supporting each claim and defense and explain how it affects your options, so you can make informed decisions about protecting your business.
We have broad experience handling disputes involving a wide variety of legal issues in multiple industries, including agricultural products, chemicals, and machinery; construction and heavy industry; restaurant and hospitality; medical devices; software; and finance. That experience helps us understand how customers encounter competing trademarks, assess market overlap, and identify relevant evidence. We use that understanding to develop a strategy with you that reflects your business goals and the circumstances of your case.
At Sierra IP Law, we represent clients in filing and defending lawsuits in federal and state courts. Our federal court practice includes the Central, Southern, Eastern, and Northern Districts of California and the Western and Eastern Districts of Washington.
The Lanham Act is the principal federal law governing trademark infringement and related unfair competition claims. We handle a broad range of claims under federal and state trademark law, including trademark infringement, trade dress infringement, disputes involving counterfeit products, and dilution of famous marks. We assess the claims, available remedies, and potential defenses, such as fair use and descriptiveness. That assessment guides a case strategy tailored to your circumstances and business goals.
We develop the evidence, manage discovery, prepare motions, and present your case at trial when needed. Throughout the litigation, we explain significant developments, reassess your options, and help you make informed decisions about the next steps. When urgent relief is warranted, we pursue temporary restraining orders or preliminary injunctions to address immediate harm while the lawsuit proceeds.
We also file and defend trademark oppositions and cancellation proceedings before the United States Patent and Trademark Office’s Trademark Trial and Appeal Board (TTAB). These proceedings involve determining federal registration rights and are a common form of trademark dispute. Our firm has extensive experience successfully handling TTAB proceedings. A TTAB proceeding is often a practical option in handling trademark disputes that have not yet resulted in significant economic damage to your business.
Resolution may take one of several different forms, including settlements, coexistence agreements, licensing arrangements, or litigation to the point of a final judgment. Trademark disputes are usually resolved with an agreement between the parties, such as a settlement agreement or licensing agreement. In all cases, we consult with you to tailor our approach to your objectives, while advising you on the available actions and strategies, what the best options are, and likely outcomes of the available actions and strategies. We keep you informed throughout the whole process, explain developments clearly, and make time for your questions. Because litigation costs can escalate quickly, we discuss fee structures, anticipated expenses, and practical options so you can make informed decisions.
Our trademark services also include trademark registration services and trade dress protection, when appropriate. We first perform a trademark search to identify conflicts with existing trademarks before use, formulate a trademark registration strategy, and guide you through the registration process.
Effective brand protection starts before conflict. A trademark search can identify existing trademarks and legal risks before adopting a trademark. Our trademark searches include review and analysis of not only filings with the USPTO for confusingly similar trademarks, but also state trademark filings, unregistered common law trademark use, and international trademarks, where the client anticipates conducting business in foreign countries. Once an effective trademark search has been conducted, we advise the client on the risks of third-party trademark use, if any. This allows the client to make an informed decision about whether to move forward with using and registering the proposed trademark.
The next step for the client is usually to file a U.S. trademark registration application with the United States Patent and Trademark Office (USPTO). Not all trademark usage qualifies for federal registration, and registration is optional. However, if registration is an option, it provides high-value benefits that outstrip the costs in most circumstances. Unregistered use may establish common law rights that are limited to the client's geographic area of operation and where it enjoys consumer recognition of its trademark. In contrast, a registration with the USPTO strengthens trademark protection by providing presumptions of validity and ownership on a nationwide basis, permits the ® symbol for covered goods or services, which places any infringer on notice of your trademark rights and makes them liable for proven infringement regardless of their actual awareness of your registered mark, and enables social media and online marketplace takedowns of infringing trademark use.

Our trademark services include guidance through the registration process and trade dress protection. Our attorneys bring extensive experience prosecuting trademark applications, with a track record that includes thousands of trademark filings. We also track your trademark registration and manage the maintenance of your trademark rights through renewal filings as long as you are maintaining continuous use of the registered mark.
Trademark rights are territorial in nature and vary by country. Our trademark services also include coordinating and managing international trademark filings for our clients. We have global connections and partners through which we file and maintain foreign trademark registrations through the Madrid System and direct filings in foreign countries. Thus, if you are seeking legal protection in multiple member countries, we can be your single, centralized partner for acquiring and managing your foreign trademark rights as you build your brand globally.
Intellectual property includes trademarks, copyrights, patents, and trade secrets. Our intellectual property group handles a broad range of intellectual property matters, including patent infringement, copyright infringement, and trade secret litigation. When a brand dispute also involves copied advertising, confidential information, or domain names, we assess the overlapping rights, claims, and defenses to develop a strategy that addresses the full scope of your dispute.
Copyright protects original expression fixed in a tangible medium. We evaluate ownership questions, including assignment and work for hire status of a copyrighted work, and the requirements for enforcing your rights. For U.S. works, Copyright Office registration or refusal is generally required before filing an infringement lawsuit.
Patents provide rights to exclude others from making or selling claimed inventions. We have decades of experience preparing, filing, and enforcing patents on behalf of our clients. Some situations involve both trademark and patent infringement issues. We can assist you with both patent and trademark issues.
Trade secrets receive protection without registration, but trade secret protection requires reasonable confidentiality measures, such as non-disclosure agreements, confidentiality provisions, and access controls. We examine these measures to assess your position and identify gaps that could weaken protection. We also advise clients on managing and maintaining their trade secrets so that their rights are preserved and can be enforced.
Before taking your case, we discuss fee structures and timelines because litigation costs can escalate quickly and your participation may require significant attention and effort. Our experienced attorneys explain legal issues clearly and remain available throughout the whole process, actively advising clients on their intellectual property rights.
